TERMS & CONDITIONS OF ENTRY

Asco Motors Vanuatu is the sole distributor of Toyota and Yamaha Products, genuine parts and accessories in Vanuatu.  We are located at Lini Highway, Port Vila and in Santo.

Purchase a brand new Toyota Hilux or Toyota Landcruiser between 17 July 2020 and 14 August 2020 to be entered into a draw for the chance to win a Yamaha Crypton 110cc Scooter (“Prize”), Toyota Genuine Accessories and Free Vehicle Service (subject to terms and conditions herein).

Conditions of Entry

1. Information about the Prizes and how to enter forms part of these terms and conditions of entry. Entry into this contest is deemed acceptance of these terms and conditions of entry by each entrant.
2. Entry is open to residents of Vanuatu aged 18 years or older, who purchase a brand new Toyota Hilux or Toyota Landcruiser within the Promotion Period (“Eligible Entrants”).
3. Employees of Asco Motors Vanuatu, its related bodies corporate, suppliers, agencies, licensees and their immediate families are not permitted to enter.
4. This contest only applies within the confines of the Republic of Vanuatu.

Duration of Promotion Period

The contest will commence on Thursday, 17 July 2020 and will continue until 09.59am on Thursday 14 August 2020 (“Promotion Period”).

How to Enter

1. Eligible Entrants may enter the contest by purchasing a brand new Toyota Hilux or Toyota Landcruiser during the Promotion Period and having their names submitted into a draw.
2. The names of Eligible Entrants will be entered into a barrel located at Asco Motors Dealership Port Vila.
3. Entries will be deemed to be accepted at the time of the Winner selection.
4. Entries received will be considered final by Asco Motors Vanuatu. Entries which are incomplete, inaccurate, erroneous, illegible, inappropriate, offensive or incomprehensible or which infringe intellectual property rights will be deemed invalid.
5. Entries must be received by Asco Motors Vanuatu during the Promotion Period. Asco Motors Vanuatu does not accept responsibility for late, lost or misdirected entries.
6. If the Winner does not accept the Prize, Asco Motors Vanuatu is not obliged to provide the Winner with a substitute. Prizes cannot be redeemed for cash or exchanged for other Asco Motors products and services.

Selection of Winner  

• All names of Eligible Entrants will be put in a barrel located at the Asco Motors Port Vila Dealership. The barrel will consist of other entries.
• There will be 1 (one) Winner selected randomly from the barrel.
• The Winner will be selected at 10am Thursday, 14 August 2020 by Asco Motors Vanuatu CEO.
• The Winner will be announced on the Asco Motors Vanuatu website:ascomotorsvanuatu.com and Asco Motors Vanuatu Facebook page: www.facebook.com/ascomotorsvanuatu.

• Asco Motors Vanuatu will not enter into correspondence regarding the result of the contest.
• The Winner will have until 10am on Monday, 27 August 2020 to claim the Prize.

1. The personal information of entrants will be collected to enable Asco Motors Vanuatu to administer and promote this contest and to contact the Winner. Entrants agree that Asco Motors Vanuatu may use their personal information for marketing purposes. If an entrant does not truthfully provide all requested personal information, Asco Motors Vanuatu may determine that they are not eligible to win the Prize.
2. The Winner consents to the use of his/her name, image and social media name or handle for promotional and marketing purposes. The personal information of the Winner may be provided to others assisting, including suppliers and deliverers, and to authorities that regulate this contest.
3. All entrants whose names are submitted to Asco Motors Vanuatu:

• grant Asco Motors Vanuatu and its licensees and assignees a non-exclusive license to exercise all rights in perpetuity throughout the world in the entry material and all other material provided by the entrant to Asco Motors Vanuatu pursuant to this contest at any time;
• represent and warrant that the exercise of the rights granted to Asco Motors Vanuatu in these terms and conditions will not infringe the rights of any third parties; and
• indemnify Asco Motors Vanuatu against any loss or damage resulting from any breach of the foregoing representation and warranty.

4. By entering this contest, entrants agree to allow Asco Motors Vanuatu to repost their names on Asco Motors’ Facebook page or Asco Motors’ website.
5. To the extent permitted by law, Asco Motors Vanuatu is not responsible or liable for:

• inaccurate/incorrect transcription of entry information;
• purported entries/names that are not received for any reason, including because they are lost, misdirected or stolen, or that are received, but are late, illegible, incomplete, or sent other than as directed in the entry instructions;
• any problems or technical failures of any kind, including malfunction of any telephone network or lines, computer online systems or network, servers or providers, computer equipment, or software;
• the unavailability or inaccessibility of any service whether or not caused by traffic congestion on the Internet or at any website;
• unauthorized human intervention in any part of the contest;
• electronic or human error which may occur in the administration of the contest;
• any loss suffered or sustained, to person or property and including, but not limited to, consequential (including economic) loss arising in connection with the arrangement for supply, or the supply, of any goods or services by any person to the Winner and, where applicable, to any family/persons representing the Winner; or
• any injury or damage to persons or property, including to the participant’s or any other person’s computer related to, or resulting from, participation or downloading any materials in this contest.

1. Toyota Genuine Accessories value is limited to 200,000 VUV and subject exclusively to aged-stock, no back-orders and stock availability; not redeemable for cash. Free Vehicle Service is limited to 15,000 VUV; the winner will be responsible for any excess/difference for service costs exceeding this limit.  Free Vehicle Service is applicable only to New Toyota vehicles purchased during the Promotion Period.
2. Asco Motors Vanuatu will not be liable for personal injury suffered during participation in the contest or use of the Prize, except to the extent directly caused by Asco Motors Vanuatu’s negligence. If requested by Asco Motors Vanuatu, the Winner, and his or her agents and assigns, must sign and return any liability release and indemnity provided by Asco Motors Vanuatu and/or its contractors as a condition of the Prize being awarded. Failure to return the signed releases and indemnities may result in the entitlement to the Prize being forfeited.
3. The above conditions do not affect, and is not intended to affect, any rights a consumer might have, which cannot be excluded under applicable consumer protection laws in Vanuatu. To the fullest extent permitted by law, any liability of Asco Motors Vanuatu or its servant or agents for breach of any such rights is limited to the cost of the Prize.

Asco Motors Vanuatu invites you to enter its “Best photo capturing the spirit of Toyota and Yamaha moment” contest via the Asco Motors Vanuatu Facebook page: www.facebook.com/ascomotorsvanuatu/competition by submitting photos that capture “a spirit of Toyota and Yamaha moment” for the chance to win a Yamaha ET1 Generator (“Prize”).

 

Conditions of Entry

Duration of Promotion Period

The contest commenced on Thursday, 9 July 2020 and was to conclude at 11.59pm on Thursday 16 July 2020.  However in recognition of Vanuatu’s 40 years of Independence celebrations, the closing date has now been extended to 10.00am on Friday 14 August 2020 (“Promotion Period”).

How to Enter

1. Eligible Entrants may enter the contest by going to the Asco Motors Vanuatu Facebook page and follow the instructions to enter the contest and upload photos.
2. Photos must consist of either a Toyota or Yamaha product or a combination of both products, and reflect a “Toyota or Yamaha moment” uploaded to the Asco Motors Vanuatu Facebook page.
3. In addition to this, all entries into the “Best photo capturing the spirit of Toyota and Yamaha moment” contest during the Promotion Period will be entered into a separate draw for the chance to win a Yamaha Crypton 110cc Scooter (“Minor Prize”);
4. Entries will be deemed to be accepted at the time of the Winner selection.
5. Eligible Entrants will receive 1 (one) entry into the Contest.
6. Entries received will be considered final by Asco Motors Vanuatu. Entries which are incomplete, inaccurate, erroneous, illegible, inappropriate, offensive or incomprehensible or which infringe intellectual property rights will be deemed invalid.
7. Entries must be received by Asco Motors Vanuatu during the Promotion Period. Asco Motors Vanuatu does not accept responsibility for late, lost or misdirected entries.
8. Any costs associated with accessing the contest (internet service provider fees, data, bandwidth etc.,) are the responsibility of each entrant.
9. If the Winner does not accept the Prize, Asco Motors Vanuatu is not obliged to provide the Winner with a substitute. Prizes cannot be redeemed for cash or exchanged for other Asco Motors products and services.

Selection of Winner – Yamaha ET1 Generator   

• There will be 1 (one) Winner selected by Asco Motors Vanuatu from all eligible entries.
• The Winner will be selected at 10am Friday, 14 August 2020 by a panel of Asco Motors Vanuatu staff.
• The Winner will be notified via mobile and email (using the contact details for the Winner in Asco Motors’ Vanuatu records) the same time and day of the selection and will be requested to attend Asco Motors Vanuatu immediately.
• Asco Motors Vanuatu will not enter into correspondence regarding the result of the contest.
• The Winner will have until 10am on Monday, 27 August 2020 to claim the Prize.

Selection of Minor Prize Winner – Yamaha Crypton 110cc Scooter

• All eligible entries will be put in a barrel located at the Asco Motors Port Vila dealership. The barrel will consist of other entries.

• The Minor Prize Winner will have until 10am on Thursday, 27 August 2020 to claim the Minor Prize.
